Refer & Earn Terms and Conditions

PLAIN-ENGLISH NOTE — These Terms are designed to be read by anyone, not just lawyers. They cover what you earn, how we pay you, what you cannot do, and how the program works. If anything is unclear, email kosi@thenewbuildlifestyle.co.uk and we will explain.

1. About this program

The Refer & Earn program (“Program”) is operated by THE NEW BUILD LIFESTYLE LTD (“we”, “us”, “our”), Company No. 16374001, registered office 3rd Floor, 86-90 Paul Street, London, EC2A 4NE. It rewards you with a flat £500 cash incentive when you introduce a new customer who buys a new-build home through our Buy Assist service. These Terms govern your participation. By using your referral code or link, you accept these Terms.

2. Who can join

The Program is open to anyone, including our panel partners. You can take part if you:

  • are aged 18 or over;
  • have a UK bank account in your own name;
  • are not employed by THE NEW BUILD LIFESTYLE LTD;
  • are not referring yourself or anyone in your household;
  • agree to these Terms.

Panel partners — mortgage brokers, conveyancers, insurers, snaggers, developers, tradespeople or any other professional we work with — are welcome to join the Program and earn the same flat £500 per successful referral as any other participant. The Program does not affect or replace any separate Introducer Agreement you may have with us; the two operate independently.

Regulatory disclosure (regulated professionals only). If you are a regulated professional (for example a solicitor regulated by the Solicitors Regulation Authority, or a mortgage broker authorised by the Financial Conduct Authority), you are solely responsible for any disclosure or transparency obligations to your own clients under your regulator’s rules in relation to any £500 referral fee you earn under this Program. We are not party to your client relationship and accept no responsibility for your compliance with your professional body’s requirements.

You are automatically enrolled in the Program when you create any account on thenewbuildlifestyle.co.uk. If you do not wish to take part, simply do not share your referral code.

3. Your referral code

When you create an account we issue you a unique referral code (for example, “SARAH-K9X2”) and a personal sharing link. You can use either when introducing someone new. Your code is personal to you and must not be sold, transferred or used by anyone else.

4. How you earn — £500 per successful referral

£500 Flat payout per successful referral. No tiers, no percentages, no overrides, no caps. The same amount applies whether the property is £200,000 or £1,000,000.

You earn £500 when each of the following is true:

  • a new customer signs up using your referral code or link;
  • that customer engages Buy Assist (THE NEW BUILD LIFESTYLE’s free buying service);
  • that customer reaches the Exchange of Contracts stage on a property reservation we facilitated;
  • that customer is not previously known to us (we have not had prior contact through any other channel);
  • we have not previously paid £500 in respect of this same customer.

Why exchange and not the first call?

Buy Assist itself is free to the customer, so there’s no payment to anchor your reward to. Exchange of Contracts is the first moment the customer is genuinely committed (legally binding under UK law, deposit deployed, developer commission to us contractually locked in) — that’s the natural point to pay you.

How we pay

We pay your £500 by Stripe Connect to your nominated UK bank account on the monthly payout cycle (the 15th of each month) following your customer’s exchange. In practice your £500 typically lands within 30 working days of the customer’s exchange.

If a sale falls through after exchange (rare)

Exchange of Contracts is legally binding under UK law and sales after exchange very rarely fall through. In the rare cases where they do (typically through legal default or extreme force majeure), the developer’s referral commission to us may be reversed. If that happens after we have already paid you £500 on this customer, we may claw back the £500 from your future earnings or, if your unpaid balance is insufficient, claim it as a debt. We will always notify you in writing before any clawback. This protects fairness on both sides of the program.

5. Payouts

5.1 Earnings move through three states in your dashboard: PENDING (awaiting your customer’s exchange of contracts), CLEARED (the exchange has happened and funds are confirmed), and PAID (sent to your bank).

5.2 We pay out when your CLEARED, unpaid balance reaches £25. Below that threshold, balances roll forward to the next monthly payout. In practice, since each successful referral pays £500, this threshold is a formality — a single successful referral always triggers payout.

5.3 Payouts are released automatically via Stripe Connect to the UK bank account you provided. You add and verify your bank account once, in your account settings, before your first payout.

5.4 Bank transfers typically arrive within one business day of release but can take up to three business days depending on your bank.

5.5 All payouts are gross of any taxes you may owe (see clause 7).

5.6 You are responsible for keeping your bank details accurate. Payments to incorrect bank details due to your error are not our liability.

6. Identity verification (KYC-Lite)

6.1 When your lifetime earnings on the Program reach £1,000 — i.e. your second successful referral — we will ask you to complete a quick identity verification step before your next payout. This is also the HMRC self-assessment reporting threshold so the timing is intentional.

6.2 Verification is handled via Stripe Identity. You upload a photo of your photo ID (driving licence or passport) and a short selfie. The check takes 60 seconds.

6.3 We use this to confirm you are who you say you are, that you are over 18, and that the bank account details we are paying into match your verified identity. This protects you from fraud and us from misuse of the Program.

6.4 We do not retain the ID document after verification — only a confirmation that verification was passed.

7. Tax and HMRC

7.1 You are solely responsible for declaring earnings from this Program to HM Revenue & Customs as required and paying any tax owed.

7.2 We do not deduct tax at source. The amount you receive in your bank account is the amount we pay to you; what tax (if any) you owe is between you and HMRC.

7.3 If you receive £100 or more from this Program in any UK tax year, you may need to declare it on your self-assessment return. If you are unsure, we recommend speaking to an accountant or HMRC directly.

8. What you must not do

Participation in the Program comes with rules. You must not:

  • pretend to be us, our staff, our brand, or our panel partners;
  • use our brand name, logo or trade marks in advertising without our prior written permission;
  • buy paid advertising on our brand keywords (Google, Bing, Meta, TikTok or any other platform) — this is bidding for our brand traffic and is strictly prohibited;
  • use spam, deceptive marketing, fake reviews or misleading claims about our services;
  • offer your referral code in exchange for cash payments from the new customer (Buy Assist is already free to them — no additional inducement is authorised);
  • refer yourself, anyone in your household, or anyone whose details you control or have created;
  • combine your referral code with any other discount code or promotional offer;
  • engage in any fraudulent activity, including creating fake accounts, gaming the system, or attempting to exploit technical issues;
  • do anything illegal in the United Kingdom in connection with this Program.

If we believe in good faith that you have breached these rules, we may withhold or reverse any unpaid earnings, terminate your participation, suspend or delete your account, and where appropriate report you to relevant authorities.

9. No guarantees

We do not guarantee any minimum earnings under this Program. The Program depends on actual customer behaviour — whether your referred customer reaches Exchange of Contracts — which we cannot promise. We may suspend, modify or close the Program at any time on 30 days’ written notice to participants. Earnings already accrued and payable on the date of any closure will still be paid out in accordance with these Terms.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes (including changes to the £500 payout amount), we will email all enrolled participants at least 14 days before the changes take effect. Continued participation after the effective date constitutes acceptance.

11. Privacy

We process your personal data (including your contact details, bank account details once provided, and Program activity) in accordance with our Privacy Policy. You can request access to or deletion of your data at any time by emailing kosi@thenewbuildlifestyle.co.uk.

12. Our liability

Our total liability to you under or in connection with the Program is capped at the total amount we have paid you, or could properly have paid you, under these Terms in the 12 months immediately before the event giving rise to the claim. Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or anything that cannot be limited by law.

13. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The English courts have exclusive jurisdiction over any dispute arising under or in connection with these Terms.
